Smartphones and connected products supported by the android OS, Apple iOS and Microsoft Windows OS are not private, secure or safe forms of telecommunications and computing.  Consumers cannot purchase a private, secure or safe smartphone or flip phone.

T-Mobile And Verizon admit that smartphones are not private, secure or safe forms of telecommunications and computing yet these companies are not required by The FCC, FTC, state AGs and law makers to be transparent with their customers in regards to privacy, cyber security and safety threats posed by connected products such as smartphones.

TV ads and telecom sales reps mislead consumers by not being transparent in regards to Google, Apple, Microsoft and Samsung's predatory surveillance and data mining business practices.  All parties concerned are engaged in fraud inducement due to a lack of transparency pertaining to surveillance and dating mining business practices.

  • T-Mobile Admission: “We, too, remember a time before smartphones when it was reasonable to conclude that when you activated service with T-Mobile that only T-Mobile would have access to our personal information. However, with the Samsung Galaxy Note, the iPhone, and many other devices, there are indeed a variety of parties that may collect and use information.” — T-Mobile Privacy Team (FCC Consumer Complaint #423849 Filed by Rex M. Lee/Public Record).

  • Verizon Admission: "We have reviewed your request at the highest levels of our organization and have confirmed that the only solutions to make a phone private and secure are available through third parties, not directly from Verizon...Additionally, Verizon is not equipped to address preinstalled solutions or applications on any device"

  • Safety Threats.  Companies such as Google, Facebook and Spotify admit that they develop addictive, intrusive and harmful technology in order to monitor, track and data mine technology product users for financial gain by way of uncontrollable preinstalled predatory surveillance and data mining technology supported by exploitive terms of use.

  • Misuse of Personal & Professional Information- Artificial Intelligence (“AI”), Predictive Analytics & Suggestive Technology.  All parties concerned use AI, predictive analytics and suggestive technology to manipulate technology product users including children into taking actions such as purchasing a product, clicking on a link, engaging a manipulative automated chat-bot that is passed off as a person or voting for a presidential candidate (see admissions below).

  • Antitrust- No Access to Private, Secure and Safe Telecommunications & Computing.  According to T-Mobile and Verizon (See Admissions Below), a consumer or business cannot purchase a private, secure and safe wireless telecommunications product such as a smartphone, tablet pc or a connected product that is supported by the android OS (Google), Apple iOS and Microsoft Windows OS.

Due to predatory surveillance and data mining business practices employed by Google, Apple And Microsoft the dominant

OS developers in the market place, it is impossible to purchase a private, secure and safe wireless telecommunications

product, tablet pc, pc in general or a connected product.

It is impossible for a consumer or business to purchase a private, secure and safe smartphone and/or connected product

due to the fact that Google, Apple and Microsoft dominate the operating system ("OS") market while employing predatory

surveillance and data mining business practices.

Due to Google, Apple and Microsoft's control of the OS market, all parties concerned can leverage device and product

manufacturers making sure that most of the connected products on the market are supported by predatory surveillance

and data mining business practices leaving consumers and business no choice but to purchase and use addictive,

intrusive, harmful and exploitive telecommunication products and connected products.

Addictive, Intrusive, harmful and exploitive connected products include tablet pcs, pcs, toys, tvs, vehicles, games, voice

automated products, appliances, home security & environmental control systems and the list goes on................

  • Telecom Provider and Government Compliance in Regards to Violations of Consumer Laws, Unfair Business Competition and Antitrust.  Companies such as AT&T, T-Mobile, Google, Apple, Microsoft, Samsung and other tech giants are enabled by government to continue to exploit consumers, children and business professionals for financial gain by way of unfair business practices and deceptive trade practices associated with addictive, intrusive, harmful and exploitive technology.

  • Violations of Consumer Laws Governed by the FCC and State AGs.  I've submitted a Texas Deceptive Trade Practices Act (“DTPA”) analysis highlighting numerous violations of consumer laws to U.S. Senator Ted Cruz's office, State Senator Donna Campbell’s office and Texas State AG's office, Ken Paxton.

To date all parties concerned refuse to investigate my claims of fraud inducement, unfair business and deceptive trade

practices unfair business competition and antitrust even though I’ve provided hard data and photographic evidence to back

my research, analysis and claims regarding violations of consumer laws, unfair business competition and antitrust.

  • See Texas DTPA Violations:

Consumer privacy advocates such as the ACLU and EFF refuse to address predatory surveillance and data mining

business practices employed by tech giants such as Google, Apple, Microsoft, Amazon, Facebook, Sony, Samsung and

   other tech giants.

  • Lack of Action from Privacy Advocates.  The EFF is focused on government surveillance but Surveillance Capitalism poses a greater threat to civil liberties and privacy than government surveillance.
  • Consumer and Child Civil Liberty, Privacy, Safety & Product User Exploitation Threats.  In 2013, congress approved a bill that was written by Silicon Valley lobbyist which enabled adults and children from the age of 13 to 17 to execute exploitive and predatory legal agreements employed by tech giants such as Google, Apple, Microsoft, Facebook, Twitter, Amazon and the List Goes On.........

The predatory and exploitive legal agreements enable tech giants to exploit consumers and children for financial gain at

the expense of the consumer and child's civil liberties, privacy, cyber security and safety due to the fact that tech giants do

not indemnify (protect) their customers from harm even if the tech giant is negligent with the product user's personal and

professional information as is the case regarding the Facebook Cambridge Analytica scandal.

  • Selling Access To Customers & Product Users.  Companies such as Google are enabled to sell access to U.S. Technology product users to state actors such as BAIDU A Chinese state owned company (see enclosed example below).  What other state actors can buy access to U.S. technology product users?

The terms of use that supported smartphones and connected products are not transparent in regards to the fact that tech

giants can sell access to their product users to state actors or companies that employ predatory surveillance and data

mining business practices rooted in “Surveillance Capitalism”.

  • SEC Violations.  According to my research, companies such as Google, Apple and Microsoft are enabling companies such as Facebook and BAIDU to monitor track and data mine non-Facebook and BAIDU customers and/or subscribers via predatory uncontrollable preinstalled surveillance and data mining technology such as apps and interactive application permission command strings.

Forced Participation- Uncontrollable Preinstalled Surveillance & Data Mining Technology.  Are companies such as

Facebook, Amazon and BAIDU submitting information associated with non-customers and subscribers to Wall Street

analyst to bolster stock value?  See android (Google) BAIDU and Facebook examples below (interactive application

permission command strings- proof of Google BAIDU preinstalled uncontrollable Chinese surveillance technology):

The time has come for government officials and law makers to implement policies and pass legislation that will protect citizens, children and business processionals from companies that employ predatory surveillance and data mining business practices rooted in Surveillance Capitalism.

Formal FCC Complaint Against AT&T & T-Mobile

Read Complaint Letter Filed on 08.18.2018

Telecom Subscriber vs. AT&T, T-Mobile, Google, Apple & Samsung

I've Spent the past four plus years of my life researching and analyzing connected products supported by the android OS (Google), Apple iOS and Microsoft Windows OS.

In other words, I simply researched and analyzed the terms of use and preinstalled content (OS, Apps, Widgets, Etc.) that supported the Samsung Galaxy Smartphones, Apple iPhones and PCs that I purchased for my wife, children and myself from T-Mobile, AT&T and Best Buy.

My research and analysis exposed numerous civil liberty, privacy, cyber security, safety and product user exploitation threats that I documented in a Smartphone Terms of Use and Preinstalled Content Report.

Dating back to 2015, I've filed numerous complaints that have gone unresolved with AT&T, T-Mobile, Google, Apple and Samsung due to the numerous threats that my research and analysis have exposed.

Additionally, I filed numerous complaints that have gone unresolved with the FCC, FTC, State AGs and Law Makers against AT&T, T-Mobile, Google, Apple and Samsung dating back to 2015.

All complaints concerned have gone unresolved by all parties concerned even though I've provided proof of my claims in the form of documentation, photographic evidence plus evidence associated with violations of consumer laws at the state and federal level.

I  simply want AT&T, T-Mobile, Google, Apple, Microsoft and Samsung plus all relevant preinstalled content developers such as Facebook, Amazon and BAIDU to be transparent in regards to their surveillance and data mining business practices due to the fact that I'm the paying customer.

Due to the fact that I've paid for all products concerned, all parties concerned have a legal responsibility to address (with granular detail) my complaints and questions associated with the civil liberty, privacy, cyber security, safety and product user exploitation threats that my research, documentation and analysis have exposed.

Furthermore, I want to know if I have purchased Addictive, Intrusive and Exploitive technology that can bring harm to my wife, children, myself and my business dealings since I use products such as my smartphone for personal and professional purposes.

Specifically, I want to know if our protected (due process & 4th amendment) telecommunication related personal and professional information is ending up in the hands of Data Brokers, State Actors, Law Enforcement, Business Competitors, Bank and Insurance Underwriters, Institutions of Higher Learning, Employers and other entities that could bring harm to my wife, children, myself and my business dealings.

  • "Who wants to pay for addictive, intrusive and harmful telecommunication products and computers that enable the product developers to exploit the product user for financial gain at the expense of the product user's civil liberties, privacy, cyber security and safety?"

Frankly, I believe that companies such as Google, Apple and Microsoft have stolen our protected telecom related personal and professional information associated with the smartphones and computers that I've purchased for my family and myself due to the fact that all parties concerned employ "Non-transparent" predatory surveillance and data mining business practices supported by unfair business and deceptive trade practices associated  with illegal terms of use.

I also believe that it is illegal to mislead consumers and businesses by hiding preinstalled application legalese that is supported by application product warnings from product owners and users.

Don't take my word for this claim, read the preinstalled android (Google) application legalese and product warning below for yourself:

Based on my research of connected products, preinstalled content and the terms of use that support all products concerned, I believe that my wife, children and myself have not given companies such as Google, Apple and Microsoft Effective ("Lawful") consent to Monitor, Track and Data Mine our activity associated the smartphones and computers that I've purchased from T-Mobile, AT&T and Best Buy.

As a matter of fact, I do not believe any American Citizen, Child and Business Processional are giving all parties concerned Effective Consent in regards to predatory surveillance and data mining business practices employed by companies such as AT&T, T-Mobile, Verizon, Sprint, Google, Apple, Microsoft, Samsung, Facebook, Amazon, Sony, BAIDU and the list goes on....

I believe that we were also fraudulently induced into purchasing Addictive, Intrusive, Harmful and Exploitive Technology due to a lack of transparency on the part of AT&T, T-Mobile, Google, Apple, Microsoft and Samsung.  Additionally, TV ads and the sales process do not include the fact that telecom related products and computers supported by the android OS, Apple iOS and Microsoft Windows OS are Not Private, Secure or Safe forms of Telecommunications and computing.

Don't take my word for these claims, Google, Facebook, Spotify, T-Mobile and Verizon admits that these claims are valid (see enclosed admissions below for details).

In closing, if you own a smartphone or a connected product supported by the android OS, Apple iOS and Microsoft Windows OS, you too have been victimized and should file complaints with all parties concerned plus file legal action against all parties concerned.

  • "To lose privacy is bad enough, but to be exploited for financial gain at the expense of civil liberties, privacy, cyber security and safety by the companies that I patronize with my loyalty, trust and hard earned money is unacceptable to me as an individual living in a country supported by a constitution that protects civil liberties such as privacy" - Rex M. Lee

Un-resolved Complaints

As of September of 2018 the FCC, FCC, state AGs, Law Makers, AT&T, T-Mobile, Verizon, Samsung, Google, Apple, DHS, the EFF, ACLU and media refuse to investigate violations of consumer law plus civil liberty, privacy, cyber security and safety threats associated with connected products supported by the android OS, Apple iOS and Microsoft Windows OS  Below is a list of all violations concerned:

  • Illegal Terms of Use. Illegal terms of use are supported by uncontrollable preinstalled ("rooted") predatory content programmed to enable preinstalled content (OS, apps, widgets, etc.) developers with the ability to monitor, track and data mine telecom subscribers ("paying customers") and connected product users for financial gain without compensating the product user for the use of the product user's personal and professional information.

  • Fraud Inducement.  TV ads and other forms of advertising are not transparent in regards to surveillance and data mining business practices rooted in “Surveillance Capitalism”.

Ads fail to explain that telecom related products such as smartphones and connected products supported by the android

OS, Apple iOS and Microsoft Windows OS are not private, secure and safe forms to telecommunications and mobile

    computing.

Ads fail to explain that the smartphone and/or connected product user will be monitored, tracked and data mined for

financial gain by the preinstalled content developers which include companies such as Google, Apple, Microsoft,

Facebook, Amazon and other tech giants.

  • Unfair Business Practices & Deceptive Trade Practices.  Companies such as Google, Apple And Microsoft use uncontrollable preinstalled surveillance and data mining technology supported by predatory terms of use that are illegal according to consumer laws at the state and federal level.

Deceptive Trade Practices- Unpublished (Hidden in Device) Terms of Use.  Companies such as Google, Apple and

Microsoft are enabled by law makers, the FTC, FCC and state AGs to use published (online) and unpublished (hidden in

device) terms of use in order to mislead product owners and/or users in regards to predatory surveillance and data mining

     business practices.

Misleading and exploitive terms of use enable all companies concerned to exploit the product user for financial gain at the

expense of the product user's civil liberties, privacy, cyber security and safety whether the product user is an adult, child,

business professional, judge, government official, government employee, member of the military, member of law

enforcement, attorney, doctor, law maker and the list goes on………..

Uncompensated Information Producers.  Product users are turned into "Uncompensated Information Producers" that are

being exploited for financial gain at the expense of the product user’s civil liberties, privacy, cyber security and safety by

the very tech companies that the product user patronizes with their loyalty, trust and hard earned money.

  • Unfair Business Competition and Antitrust. Companies that compete in numerous industries worldwide such as Google are enabled by telecom providers such as AT&T, law makers, the FCC and FTC to monitor, track and data mine individuals, children, professionals (doctors, attorneys, etc.), govt. officials, business professionals and even law makers via telecommunications devices such as smartphones supported by protected (due process/4th amendment) telecom infrastructure governed by the FCC.

Protected Telecom Infrastructure Governed by the FCC.  Any company that can monitor, track and data mine

telecommunication subscribers via telecom related connected products such as smartphones, tablet PCs and vehicles

has a huge advantage over any of their competitors.  This is an unfair business competition and antitrust issue that the

FTC, DOJ and law makers need to address.

Formal Complaint- AT&T

Law Makers, The FTC, FCC, DHS and DOJ refuse to protect consumers, children and business professionals from exploitive tech companies that employ predatory surveillance and data mining business practices plus sell and support addictive, intrusive, harmful and exploitive technology.

  • "What other CEO's can get away with calling their customers "Dumb Fucks"  while other senior executives and product designers admit that they develop addictive, intrusive and harmful technology in order so that all companies concerned can exploit their customers for financial gain at the expense of their customer's civil liberties, privacy, cyber security and safety whether their customer is an adult, child or business professional?"

Don't take my word for these claims- Google, Facebook and Spotify publically admit that they intentionally develop addictive, intrusive, harmful, and exploitive technology in order to exploit their customers for financial gain yet law makers, government agencies such as the FTC, state AGs and telecom providers such as AT&T have not taken any action to protect consumers, children and business professionals these types of harmful and exploitive business practices:

  • Mark Zuckerberg (Co-founder of Facebook): “Yea so if you ever need info about anyone at Harvard, just ask. ‘i have over 4000 emails, pictures, addresses, sns”   Friend: “what!? how’d you manage that one?”  Zuckerberg: people just submitted it. i don’t know why. they “trust me”. dumb FUCKs”- Daily Mail, March 19th, 2018

  • Eric Schmidt (Former Chairman of Alphabet Inc.- Google):  "I actually think most people don't want Google to answer their questions [...] They want Google to tell them what they should be doing next,"- Eric Schmidt Wall Street Journal 2010

“We don’t need you to type at all because we know where you are. We know where you’ve  been. We can more or less

guess what you’re thinking about … Is that over the line?” – Eric Schmidt Fox Business 7.05.2016

  • Sean Parker (Co-Founder Facebook & Spotify): "It's a social-validation feedback loop ... exactly the kind of thing that a hacker like myself would come up with, because you're exploiting a vulnerability in human psychology..............God only knows what it's doing to our children's brains..............The inventors, creators — it's me, it's Mark [Zuckerberg], it's Kevin Systrom on Instagram, it's all of these people — understood this consciously. And we did it anyway....”- Sean Parker, Axios- November 9th, 2017.

  • Tristan Harris Quotes (Former Google App Developer) A Time Well Spent: “The average person checks their phone 150 times a day. Why do we do this? Are we making 150 conscious choices? One major reason why is the #1 psychological ingredient in slot machines: intermittent variable rewards . . . Addictiveness is maximized when the rate of reward is most variable.........By shaping the menus we pick from, technology hijacks the way we perceive our choices and replaces them with new ones. But the closer we pay attention to the options we’re given, the more we’ll notice when they don’t actually align with our true needs.”
